CMS Issues Changes to Home Health Beneficiary Notices

On September 6, the Centers for Medicare & Medicaid Services (CMS) released change requests (CR) 8403 and 8404, which detail changes to the Home Health Advanced Beneficiary Notice (HHABN) and inform agencies on the use of the Advanced Beneficiary Notice (ABN) and the Home Health Change of Care Notice (HHCCN). The HHABN will be discontinued and replaced by the HHCCN — formatted with Option Box 2 or Option Box 3 for change of care notifications. Option Box 1 formatting of the HHABN for beneficiary liability notification will be replaced with the existing ABN, Form CMS-R-131.

The HHCCN has been created to notify beneficiaries of reductions in service for other reasons as required by the Lutwin v. Thompson decision. The HHCCN will replace both Option Box 2 and Option Box 3 formats of the HHABN.

The ABN and HHCCN forms must be implemented to notify Medicare beneficiaries of any financial liability and /or changes in care by December 9. After this date, the HHABN will no longer be valid.
