Temple University, former department chairman settle fraud claims

Compliance Monitor, May 23, 2012

Temple University and a former chairman will pay $1 million to resolve allegations the university improperly billed Medicare for services that were provided by residents, but billed as though performed by attending physicians.

A jury convicted Joseph Kubacki, MD, former chairman of Temple's Ophthalmology Department, of 73 counts of health care fraud, 73 counts of false statements in health care matters, and four counts of wire fraud in August 2011. The trial evidence showed Kubacki charged Medicare for services performed when he was not in the hospital, according to a press release from the U.S. Attorney’s Office for the Eastern District of Pennsylvania.
The settlement resolves these claims against Temple as well as claims of  fraud in Temple's plastic surgery department. Temple voluntarily disclosed the fraud to the government and will not be subject to a Corporate Integrity Agreement.
