Compliance Monitor, October 19, 2011

Nemours®, a children’s healthcare system with locations in Delaware, Florida, New Jersey, and Pennsylvania, announced in an October 7 press release that three backup tapes are missing from their Wilmington, DE facility.

The missing tapes contain patient data (e.g., name, address, date of birth, Social Security number, insurance information, medical treatment information, and direct deposit bank account information) gathered from 1994 to 2004, the company said in the press release.

Nemours® discovered the breach during September, a month after an office remodeling project at the Wilmington location, it said in the press release. The company said it thinks a cabinet containing the tapes was removed a month earlier during the remodeling project. . Nemours® does not believe the information has been stolen or that any information has been used inappropriately.

“This is an isolated incident unrelated to patient care and safety,” David J. Bailey, MD, president and CEO, said in the press release. “The privacy of our patients, their families, and our employees and business partners is a high priority to all of us at Nemours®.”

Nemours® currently is informing individuals who may have been affected by the privacy breach.
