FL radiology clinic settles anti-kickback allegations

Compliance Monitor, June 15, 2011

Midtown Imaging LLC, a radiology clinic, and its former owners have agreed to pay $3 million to resolve allegations that the clinic violated the False Claims Act, according to a Department of Justice press release.

The West Palm Beach, FL clinic entered into certain leasing and professional services agreements with referring physicians and physician groups that violated the Anti-Kickback Statute and Stark Law. Due to the agreements, the clinic allegedly submitted false claims to Medicare for an eight-year period, beginning in 2000.

Two former Midtown Imaging radiologists, Teresa M. Cortinas, MD and Walter E. Wojcicki, MD filed the lawsuit under the whistleblower provisions of the False Claims Act. They will receive a $600,000 share of the settlement.
