Former Temple University department chairperson indicted on fraud charges

Compliance Monitor, February 2, 2011

Joseph Kubacki, MD, former chairperson of the ophthalmology department at the Temple University School of Medicine, faces 114 counts of healthcare fraud and making false statements in healthcare matters, according to a Department of Justice (DOJ) press release.

According to the DOJ, Kubacki caused false claims, totaling more than $3 million, to be submitted for services rendered to patients whom Kubacki did not personally see or evaluate. The DOJ claims that Kubacki instructed his staff to stack patient charts of patients seen by other physicians in front of his office. He would then allegedly make false notations in the charts to make it seem that he had seen the patients personally and sign the charts.

If convicted, Kubacki faces a prison term, a fine of $36 million, mandatory restitution, and three years supervised release.
