Q&A: Are business associates covered entities?

A: The HITECH Act does not classify business associates as covered entities. Covered entities are only those entities originally classified as such in the HIPAA Administrative Simplification provisions.

These rules continue to define business associates as they did before enactment of HITECH. HITECH identifies new entities to be treated as business associates, but does not alter the definitions of covered entity and business associate.

The HITECH Act changed what business associates must do with respect to the HIPAA privacy and security rules.
