Whistleblower acquitted of felony charges

Compliance Monitor, February 17, 2010

A Texas jury acquitted a nurse whistleblower of felony charges alleging she misused official information when she reported a physician was using unsafe medial practices, according to the New York Times.

Anne Mitchell, 52, a former nurse at Winkler Country Memorial Hospital wrote a letter to her medical board alleging coworker, Dr. Rolando G. Arafiles Jr., used dangerous methods such as operating in the emergency room without surgical privileges. According to the New York Times, the prosecution stated that Mitchell abused her position to obtain and disseminate patient file numbers.

Fellow nurses at Winkler vouched that Mitchell’s concerns were legitimate and the hospital did not appropriately handle the complaints.

Mitchell’s lawyers filed a lawsuit against the hospital and various officials on charges of violating due process and First Amendment rights.
