St. Louis doctor faces ten year prison sentence and $250,000 fine

Compliance Monitor, January 13, 2010

A St. Louis ear, nose, and throat specialist faces ten years in prison and a $250,000 fine if convicted of multiple healthcare fraud allegations, according to a Department of Justice (DOJ) press release.
The DOJ reports that Wallace P. Berkowitz, MD, submitted numerous false claims to Medicare and Medicaid for exaggerated services or ones not provided. Berkowitz, a sole practitioner in St. Louis and Illinois, documented false records, including reports of spending 25 to 45 minutes with a patient, when in reality, he typically spent five.
Berkowitz falsely billed Medicare and Medicaid for using anesthesia to remove foreign bodies from a patient’s ear, when he simply removed impacted ear wax without anesthetic assistance, along with other false procedures.
