NYC and Justice Department intervene in neglectful psychiatric center suit

Compliance Monitor, January 13, 2010

New York City’s Attorney’s office and the Justice Department’s Civil Rights Division will intervene at Kings County Hospital Center’s (KCHC) psychiatric emergency room and inpatient ward to rectify conditions of neglect and improper care to patients, according to a Department of Justice (DOJ) press release.
A December 2007 joint investigation revealed that KCHC failed to do the following:
  • Protect patients from danger
  • Treat psychiatric disabilities
  • Treat patients by means other than drug induced sedation
  • Provide adequate discharge and follow-up services
  • Respond promptly to medical emergencies.
According to the DOJ, these violations resulted in at least one reported patient death. The patient allegedly collapsed in the psychiatric emergency room after waiting 23 hours to see a doctor. A team of compliance experts will monitor KCHC for the next five years.
