Insufficient informed consent cited in malpractice verdict

A New York jury awarded a patient who suffered complications from vision correction laser surgery (LASIK) $3 million in a malpractice lawsuit, citing insufficient informed consent as one of the reasons for the award, according to a release by PRWeb.

The jury ruled that the informed consent was insufficient despite an eight-page informed consent document, a video, a brochure, and a general discussion of risks with the referring optometrist. The jury awarded $1 million for past pain and suffering, $1 million for future pain and suffering, and $1 for future medical expenses.
