Amendment aims to lower malpractice costs in WY

The Wyoming Legislature on July 15 voted in favor of a constitutional amendment that will allow caps on malpractice damage awards. The House of Representatives voted 48-12 and the Senate voted 21-9 in favor of Joint Resolution 1003. A conference committee will work out slight differences in the bill before sending it to Gov. Dave Freudenthal, who supports the resolution. Voters will have a chance to approve the amendment in November.
Legislators introduced the resolution in response to rising malpractice insurance costs that are causing Wyoming doctors to retire or relocate, further reducing options for patients, according to Modern Physician. Wyoming ranks 49th out of the 50 states for lowest percentage of doctors.
The cap will only apply to non-economic damages such as pain, suffering, or loss of enjoyment.
