APTA Files Appeal in Breached Contract Case

APTA is appealing a decision by the Virginia Circuit Court in which it dismissed APTA's claim that the Federation of State Boards of Physical Therapy (FSBPT) breached a contract by increasing fees for the National Physical Therapy Examination. The case was originally dismissed not on the validity of the claim, but because the statute of limitations ran out. APTA claims that the FSBPT breached its contract limiting its ability to raise fees after ownership of the exam transferred from APTA to FSBPT. FSBPT raised fees three times since acquiring the exam-in 1995 from $90 to $185, in 2000 to $285, and in 2005 to $350. The court says the breach occurred in 1995, and therefore the five-year statute had passed. APTA claims each increase was a separate breach and that it must go forth with the suit for the good of its current and future students.
