Transmittal 36 updated after NATA lawsuit dismissed

CMS revised Transmittal 36 on July 25 to reflect changes to the qualifications required for staff providing services billed as PT and OT services "incident-to" the services of a physician or nonphysician practitioner. The changes came after the United States District Court for the Northern District of Texas dismissed a lawsuit brought by the National Athletic Trainer's Association (NATA), that challenged the requirements for incident-to qualifications. CMS had previously delayed implementation of these requirements as a result of an agreement made with NATA and contained in a June 3 order issued by the court.
