Medicare delays "incident-to" enforcement

A legal challenge has prompted CMS to delay enforcement of the new "incident-to" enforcement rules, originally scheduled for June 6. The rules would have ensured that "incident-to" rehabilitation services for Medicare beneficiaries were provided by qualified therapists. The enforcement is indefinitely suspended, pending an expected U.S. District Court hearing in early July, according to PT Bulletin Online. However, CMS is implementing other improvements in therapy policies that were published in the same May 6 transmittal, including new personnel standards for therapy services provided "incident-to" physician services in the physician's office, reported the Bulletin.
