Therapists win "incident to" victory

Rehab Regs, November 11, 2004

Physical therapy services provided to Medicare beneficiaries in a physician's office must be provided by a physical therapist, according to new regulations released by CMS last week. These standards also require that individuals providing outpatient physical therapy services to Medicare beneficiaries in physicians' offices, incident to a physician's professional service, have graduated from an accredited physical therapy program, according to the PT Bulletin Online. CMS will delay implementation of the new requirements until March 2005 to allow physicians to adjust to the policy, reported the Bulletin. Physician assistants, clinical nurse specialists, or nurse practitioners may continue to provide "incident to" therapy services when those services are within the scope of their state practice acts.
