First conviction for HIPAA rules violation

Rehab Regs, September 9, 2004

Richard W. Gibson, 42, of Washington, pleaded guilty in August to wrongful disclosure of individually identifiable health information for economic gain, according to a press release from the United States Attorney's Office. Gibson admitted to obtaining a cancer patient's name, date of birth, and social security number while he was employed at the Seattle Cancer Care Alliance. He later used the information to obtain four credit cards, and quickly accumulated over $9,000 in debt in the patient's name. At a hearing scheduled for November 5, a U.S. District Court judge will decide whether to accept the plea agreement. Gibson could face up to 16 months in prison.
