Proposed rule targets ’incident to’

Rehab Regs, August 5, 2004

CMS released this week a proposed rule that would only allow qualified and trained physical therapists to provide physical therapy services incident to a physician's professional services in physician-owned clinics. The CMS regulation also proposes an end to required in-room supervision of physical therapy assistants by physical therapists. It would be replaced by a "direct supervision" requirement that only calls for a physical therapist to be on the premises where a physical therapy assistant is performing services. CMS will accept comments on the proposed rule through September 24.
