Physician apology legislation gains steam in WI

Physicians often worry that an apology to an injured patient could be construed as an admission of guilt in future malpractice action. Wisconsin is the latest state to mull a law preventing simple apologies from inclusion in malpractice proceedings, according to an article in the Madison Capital Times.

Critics of the legislation say it is too broad. The law would allow physicians to make statements about fault and liability, but then offer contradictory evidence on the stand, according to the Times.

Proponents said the law is intended to give physicians a chance at a normal expression of sympathy. The hope is that an earnest apology and explanation would be enough to keep most cases out of court, according to the article.
