New law in New Jersey requires physicians to report medical errors

The New Jersey Senate passed a bill March 29 requiring doctors and hospitals to report medical errors to the state, a move that some lawmakers believe could have stopped a nurse who allegedly killed up to 40 patients in New Jersey and Pennsylvania.

 

The Patient Safety Act also requires medical centers to develop systems to avoid making these mistakes in the future. The bill now awaits approval by Gov. James E. McGreevey.

 

There is currently no law requiring disclosure of medical errors in New Jersey.

 

Lawmakers said the measure could help restore faith in the health care profession following the December arrest of nurse Charles Cullen, who was charged with killing one patient and trying to kill another at a Somerset County Hospital. Cullen told investigators he killed patients at 10 hospitals over a 16-year career.

 

Under the new law, each hospital would have to create a review board to look at medical errors and come up with plans to reduce them. The state health commissioner will notify patients-or their relatives-when a medical error occurred.
