The HCQIA provides immunity to members of the professional body as well as its staff, the hospital in charge of the body, and the people who participate in or assist the professional review body. However, physicians asked to serve on a fair hearing committee should immediately determine if the organization will indemnify them if a physician sues the panel for alleged wrongdoing.
