CMS revises guidance on past noncompliance in SNFs

Sometimes during a skilled nursing facility's (SNF) annual state inspection, surveyors stumble across situations in which the facility was out of compliance with the State Operations Manual, but corrected the problem prior to the survey. Facilities are vulnerable to citations when this occurs, according to a survey and certification letter released by the Centers for Medicare & Medicaid Services (CMS) in late October.

The letter, S&C-06-01 states that although surveyors should primarily concentrate on the SNF's present situation, they can still hand out deficiencies and civil money penalties for compliance issues that occurred since the facility's last survey. However, the letter instructed surveyors to stop using F-Tag #698 for such deficiencies-instead, they should use the Tag that best represents the problem.

CMS said findings of past noncompliance may come to light more frequently during investigations of complaints about a facility's care and services.
