CMS broadens assistance rules for Medicare Part D

Long-term care officials and pharmacy experts received some relief last Friday to a problem that has frustrated the industry since the inception of Medicare Part D in 2006. CMS stated that providers who help residents enroll in prescription drug plans are not breaking any laws, as long as they do not do so with the intent to market particular plans--that is, steer Part D enrollees toward a specific plan for the provider's own benefit--according to the Federal Register. Before, providers could not assist their residents at all, and voiced their frustration across the country at being unable, especially, to help cognitively impaired residents.
