Diabetics fight blood glucose ruling

A class action lawsuit filed on December 15, 2006, alleged that the 2007 Medicare Physician Fee Schedule final rule on blood glucose billing prevents diabetic residents from receiving coverage for blood glucose tests. The defendants in the case are CMS and Mutual of Omaha Insurance Company, which is a CMS Medicare Part B contractor. The lawsuit, Bailey v. Mutual of Omaha Insurance Co., was filed by Reed Smith LLP Washington on behalf of nursing home resident Louise Bailey and other Medicare Part B residents who need frequent blood glucose tests.
