CMS faces Part D lawsuit

The Washington Legal Foundation (WLF) filed a suit against CMS in the U.S. District Court for the District of Columbia for blocking truthful speech concerning insurance coverage available to senior citizens under Medicare Part D, stated a WLF press release. The suit stated that CMS violated the First Amendment and prohibited people from acquiring accurate information from nursing homes and pharmancies about competing insurance providers, the press release stated. Under CMS regulations, nursing homes are unable to assist residents in choosing a prescription drug plan best suited for them. The suit is attempting to stop CMS from prohibiting free speech regarding Medicare Part D.
