Tip of the week: Prevent lawsuits with thorough employee screening

Contemporary Long-Term Care Weekly, March 19, 2009

Your facility can be sued for negligence if you fail to implement preemployment screening and someone is hurt as a result of an employee’s violence. Thoroughly screening applicants and checking references is one of the best ways of preventing problems. In addition to reviewing the application, checking licensure and certification, and validating references, consider the following red flags that may come up during the interview of a prospective employee. The applicant:

•    Has had numerous jobs in a relatively brief period of time
•    Provides vague explanations for gaps in employment
•    Has a history of positions with declining salary
•    Is seeking a lower position than he or she previously held
•    Forgets (or fails) to sign the release, reference, and consent forms accompanying the application
•    Complains bitterly about former employers
•    Avoids giving straightforward answers to questions
