Mandatory mediation implemented in Illinois County

Contemporary Long-Term Care Weekly, March 13, 2008

Madison County is the first in Illinois to implement a policy requiring mandatory mediation between both parties in a nursing home malpractice case, according to the Belleville News Democrat.

In 2007, the Medical Malpractice Mandatory Mediation Program gained approval from Madison County judges. This program requires each party within a case to meet with a mediator in a controlled environment and discuss possible resolutions before going to trial. Mediation is required to take place 90 days prior to taking the parties' depositions. Nursing homes are now included in this program in hopes to speed up the resolution process.
