N.Y. AG files suit against Merck for hiding Vioxx risks

Attorney General Andrew M. Cuomo and New York City Mayor Michael Bloomberg filed a joint lawsuit against Merck & Co., Inc., claiming the company misrepresented the dangers Vioxx posed to its users.
The civil suit accuses Merck of deliberately suppressing and concealing information about serious cardiovascular risks associated with Vioxx. The suit claims many prescriptions would not have been written if doctors had been properly informed.
The lawsuit seeks damages and civil penalties in addition to restitution for taxpayer dollars spent on Vioxx prescriptions.
This is the first case brought under New York's recently enacted False Claims Act and it marks the first time the city and state have brought a joint Medicare fraud action.
