Court upholds advertising ban on Xenical in Australia

The Australian Federal Court upheld a ban on advertising for Roche's weight-loss drug Xenical.

A federal health committee in February banned Roche from advertising Xenical after complaints about the affect of the ads especially during the reality show Australian Idol. The Australian Consumers' Association said anecdotal evidence suggested girls as young as 13 in the healthy weight range were asking pharmacists for Xenical.

Roche appealed to the Federal Court, arguing the National Drugs and Poisons Schedule Committee had, in considering media coverage of Idol, breached its statutory limits. The court ruled the committee acted within its powers.

Roche will not appeal the decision.
