Nevada pharma marketing law may be all bark and no bite

The state of Nevada has passed a pharma marketing law that seems to be a weaker version of California's. The new law, which will take effect in the fall, is similar to California's in that it requires companies to establish a marketing code of conduct.

However, the Nevada law doesn't seem to have any teeth. Unlike the California law, Nevada's law will not dictate what they code of conduct must include and it doesn't require that companies post their codes online. Although both states say that adopting the PhRMA code is a sufficient code of conduct, Nevada's law sets no specifications for how long companies have to adjust their codes should PhRMA's change. Also Nevada will not require gift disclosure. Consumer group Public Citizen called the law weak and hard to enforce, according to FDA Week.
