Dey pays $2.9M to settle price-reporting litigation

California-based Dey, Inc., has paid $2.9 million to Massachusetts to settle alleged inflated wholesale acquisition costs (WAC), according to Massachusetts Attorney General Martha Coakley's office.

The settlement resolves price reporting litigation pending the Federal District Court in Boston. The Commonwealth alleged that Dey reported inflated WAC to national price reporting services, causing the Massachusetts Medicaid program to overpay for Dey drugs.

In addition to the $2.9 million Dey has agreed to pay, the company will also pay Massachusetts a 5% rebate on future purchases for five years. Although it agreed to the settlement, Dey denied any wrongdoing and said that its price reporting was consistent with legal standards.
