Judge in NH Rx datamining case asks for factual review
Pharma Compliance Alert, April 18, 2007
A federal judge asked lawyers from both sides of the New Hampshire prescription data mining case to review a draft of factual findings before his ruling. In the case, datamining companies IMS Health and Verispan are challenging a first-of-its kind New Hampshire law that limits drug company access to physician prescribing data.
Although the judge warned that no one should try to predict his ruling from the draft, the Associated Press (AP) reports that he seemed to be skeptical about New Hampshire's argument that detailing drives up drug prices.
The judge said last week that he expects to rule within 30 days. According to the AP, this closely watched case could effect at least 12 other states that are considering similar legislation. No matter the ruling, at least one of the sides is expected to appeal, reports AP.
