Certain equipment exempt from CMS' competitive bidding requirements

Device Regulation Alert: Safety, Compliance and Reimbursement News, April 16, 2007

Diabetes testing products are exempt from competitive bidding requirements, according to a CMS final rule (CMS-1270-F). According to the National Community Pharmacists Association, the rule is a victory for patients and pharmacists because it ensures that Medicare beneficiaries will be able to purchase these products from local pharmacies.

Diabetes supplies that are purchased at local pharmacies, including blood glucose level monitors, testing strips and lancets are exempt. Also exempt are some durable medical equipment, prosthetics, orthotics, and supplies.

CMS' new competitive bidding requirement goes into effect in 10 metropolitan statistical areas this year. Learn more on the CMS Web site.
