In brief: Possible DTC ban: House bill says three years, Senate says two
Pharma Compliance Alert, March 28, 2007
Last week, the House introduced a bill that would implement a three-year ban on DTC ads for new drugs, increasing by one year the two-year ban already recommended by the Senate. In addition to the three-year ad ban, the House bill also requires packaging to carry a symbol letting consumers know a drug is new to the marketplace. Both bills also mandate pre-clearance of drug ads by the FDA. Reps. Henry Waxman (D-CA), and Ed Markey (D-MA), are behind the House bill.
