Montana complaint against Lilly alleges off-label Zyprexa marketing

Pharma Compliance Alert, March 21, 2007

Last week, Montana became the seventh state to sue Eli Lilly over its alleged off-label marketing of the antipsychotic drug Zyprexa. In addition, the state's Attorney General Mike McGrath also alleges that Lilly gave kickbacks to doctors, reports Bloomberg News.

According to the report, Montana's complaint also accuses Lilly of "instructing its representatives to minimize and misrepresent the dangers of Zyprexa." The state is seeking all funds that Montana or its citizens spent on Zyprexa since the drug was launched in 1996, treble damages, and attorneys' fees.

The Montana complaint is only the latest in a string of accusations against Lilly regarding Zyprexa. Earlier this month, the Commonwealth of Pennsylvania sued Lilly alleging deceptive marketing, and Representative Henry Waxman (D-CA), chair of the Committee on Oversight and Government Reform, requested information about Lilly's Zyprexa marketing.
