J&J receives three subpoenas regarding subsidiary oversight

Pharma Compliance Alert, March 14, 2007

Johnson & Johnson (J&J) has received three separate subpoenas from three U.S. Attorney's offices. According to J&J, the subpoenas are from the U.S. Attorney's Offices in Philadelphia, Boston, and San Francisco and relate to investigations that the company had previously disclosed in Securities and Exchange Commission filings.

The subpoenas seek information regarding the sales and marketing of schizophrenia treatment Risperdal by Janssen, migraine treatment Topamax by Ortho-McNeil, and heart failure drug Natracor by Scios, all J&J subsidiaries. According to J&J, the subpoenas request information about its corporate supervision and oversight of these three subsidiaries, including its sales and marketing techniques.

J&J's subsidiaries have been the focus of attention in recent weeks. In February, J&J's Centocor unit received a subpoena in connection with an investigation into the average selling price (ASP) calculations for the drug Remicade. The company also notified the Department of Justice and the Securities and Exchange Commission last month that certain foreign subsidiaries may have made improper payments to sell medical devices.
