Appeals court reinstates product liability suit against Warner-Lambert

A federal appeals court last week reinstated a lawsuit against Warner-Lambert from a group of Michigan residents who say one of the company's drugs caused them injuries. The 2nd Circuit Court of Appeals overruled a lower court's 2005 decision to toss the suit, reports the Associated Press. That lower court cited a Michigan law that shields pharmaceutical companies from product liability unless there is evidence that the company withheld or misrepresented such information from the FDA.

However, the federal court disagreed, and reinstated the lawsuit, which claims that the diabetes drug Rezulin, which Warner-Lambert pulled from the market at the FDA's request, caused the defendants liver damage. A safety review found that Rezulin was more toxic to the liver than two other similar drugs. Pfizer acquired Warner-Lambert in 2000, just months after Rezulin's withdrawal.
