Judge rejects P&G, Sanofi arguments against Boniva marketing

A federal judge last week rejected an argument from Procter & Gamble and Sanofi Aventis claiming that Roche and GlaxoSmithKline's advertising for the osteoporosis drug Boniva is misleading. P&G and Sanofi Aventis, which co-market the osteoporosis drug Actonel, filed a suit saying that ads for Boniva falsely imply that the drug is as effective as Actonel at preventing nonspinal fractures. The suit argued that the Boniva label does not support these claims and requested a halt on the ads.

However, the judge rejected the claims, writing that "there is no doubt that Boniva is a safe and effective drug which the FDA has approved for the treatment and prevention of osteoporosis in postmenopausal women, without limitation as to vertebral and nonvertebral sites.nor is Actonel superior to Boniva."
