South Carolina AG files suit against five drug companies
Pharma Compliance Alert, August 9, 2006
South Carolina Attorney General Henry McMaster has filed a lawsuit against five pharmaceutical companies, alleging that they fraudulently manipulated the prices of Medicaid and state health plan prescription drug claims. The suit aims to recover more than $40 million in taxpayer funds, according to a report from McMaster's office.
The defendants in the suit are Abbott Labs, Baxter International, Dey, L.P., Boehringer Ingelheim Roxane, Inc., Schering-Plough, and several of those companies' subsidiaries.
The state will allege that the companies intentionally misreported the average wholesale price of selected drugs.
