OIG: Requirements for determining AMPs unclear

The OIG recently studied the requirements for how manufacturers determine average manufacturer prices (AMP) for prescription drugs and found them to be unclear. The OIG also found inconsistencies in the ways manufacturers calculate AMPs, it reports.
The OIG recommended that CMS take several steps to improve the process, such as clarifying certain requirements and issuing new guidance that specifically addresses AMP-related reimbursement.
Beginning July 1, HHS must supply AMP data to states every month, and states may choose to use the AMP data in setting reimbursement amounts. However, errors or inconsistencies in AMP calculations could lead to inaccurate reimbursements and rebate errors.
