Supreme Court rules against Wyeth in preemption case

The US Supreme Court ruled 6-3 that FDA approval does not shield pharmaceutical companies from patient lawsuits, according to the US Supreme Court’s 6-3 ruling.
On March 4, the Supreme Court affirmed the lower court’s ruling in favor of Vermont musician Diane Levine. In the majority opinion, Justice John Paul Stevens wrote the FDA’s approval does not provide Wyeth with “a complete defense to Levine’s tort claims.”
