OIG to focus on drug pricing fraud
Pharma Compliance Alert, October 8, 2008
The OIG will continue to scrutinize pharmaceutical drug pricing practices as part of the 2009 OIG Work Plan.
The OIG plans to evaluate how quickly pharmaceutical companies submit their average manufacturer price (AMP) data to CMS. CMS uses AMP to calculate reimbursement rates, and pharmaceutical companies are required to submit AMP data every month under the Deficit Reduction Act. An OIG audit found AMP data missing for almost 14% of drugs.
The OIG will also evaluate how pharmaceutical companies calculate AMP.
