Massachusetts governor explains intent of disclosure law

Although some life sciences companies are concerned that Massachusetts’ new gift restrictions will hurt their ability to do business in the state, Governor Deval Patrick said that is not the intent of the legislation.

The new law, signed by Patrick August 10:

  • Creates an academic detailing program to provide unbiased information to prescribers
  • Requires pharmaceutical and medical device companies to disclose payments to healthcare providers valued at $50 or more
  • Prohibits certain types of gifts, such as tickets to sporting events

In addition to banning some gifts and requiring disclosure of others, the law calls for the state to develop a code of conduct for industry representatives that includes a $5,000 fine for each violation. Pharmaceutical and medical device companies must also disclose the “nature and purpose” of each payment to physicians.

According to a Boston Globe article, Patrick sent a letter to the state legislature saying the new law is not intended to:

  • Force companies to disclose confidential information
  • Impede medical research
  • Block the training of healthcare providers
