Abbott under investigation for stent sales, marketing
Device Regulation Alert: Safety, Compliance and Reimbursement News, August 4, 2008
The Department of Justice (DOJ) is investigating Abbott Laboratories’ sales and marketing practices for its bile-duct stents, the company reported in its quarterly filing with the Securities and Exchange Commission.
The DOJ is trying to determine whether Abbott violated the Federal False Claims Act, the Food, Drug, and Cosmetic Act, and the Anti-kickback Statute in connection with Medicare and/or Medicaid reimbursement paid to third parties.
Boston Scientific revealed in February that the DOJ was investigating whether it and other suppliers are illegally marketing the stents for unapproved uses.
