California appeals court throws out pricing case

Pfizer and 18 other pharmaceutical companies learned they will not face charges of pricing fraud in California.

The California appeals court upheld the dismissal of a 2004 lawsuit brought by pharmacies against the pharmaceutical companies. The pharmacies claimed they paid too much for drugs because the companies inflated their prices. The case was originally dismissed in 2006.

In its ruling, the court said pharmacies had already been paid for the claimed overcharges, so any additional award would be a windfall for the pharmacies.
