Prescription information not for sale in California

Pharma Compliance Alert, June 25, 2008

Pharmaceutical companies will not be able to obtain patient prescription information from California pharmacies after all, according to a Los Angeles Times article.

SB 1096, written by state Sen. Ron Calderon, would allow pharmacies to sell patient prescription information to third-party companies. The bill passed the State Senate, but failed to earn a single vote in the State Assembly Health Committee.

The bill was intended to provide pharmaceutical companies with a way to encourage patients to take medication as prescribed and to call for refills, but critics said it violated patient privacy. The bill also provided no transparency to determine who was paying for prescription information, which led to concerns pharmaceutical companies could use the information to send targeted advertising to consumers.
