Disclosure bill gains more industry support

Pharma Compliance Alert, June 4, 2008

Senators Charles Grassley (R-IA) and Herb Kohl (D-WI) can thank Eli Lilly for starting a trend.

On May 13, Lilly spoke out in favor of a revised version of the Physician Payments Sunshine Act that would require pharmaceutical companies to disclose gifts to physicians. According to a press release from Grassley and Kohl, the bill’s supporters now include:
  • Merck
  • AstraZeneca
  • The Pharmaceuticals Research and Manufacturers Association
  • Advanced Medical Technology Association
  • Medtronic
  • Zimmer
  • The Association of American Medical Colleges
In the press release, Kohl said the legislation, if passed, would increase transparency and change the way drugs are marketed.

The legislation only received industry support after significant revisions, including the addition of pre-emption language, an increase in the threshold for gift reporting, and a decrease in the amount of fines for violations.
