Vermont Senate unhappy with federal disclosure bill

Pharma Compliance Alert, June 4, 2008

While members of the pharmaceutical and medical device industries throw their support behind a revised version of the Physician Payments Sunshine Act, not everyone appears happy the federal government is getting involved.

State Senators in Vermont believe the proposed federal law will undermine a stricter law already in place in Vermont, according to an article in the Rutland (VT) Herald.

The Vermont law, the first disclosure law passed, requires pharmaceutical companies to report gifts to physicians over $25 a year. Initially, the federal bill contained the same $25 reporting threshold, but a revised version of the bill changed it to $500.

The federal bill, which covers medical device companies, also contains pre-emption language which would allow it to override state laws, even if the state law is stricter, like Vermont’s. The federal law, if passed, would go into effect in 2011.
