Merck to pay additional $58M for Vioxx

Merck’s costs for the withdrawn painkiller Vioxx continue to mount.

Earlier this year, Merck proposed a $4.85 billion settlement with patients who claim they were harmed by Vioxx. Last week, the company agreed to pay $58 million to settle claims by 29 states and the District of Columbia that it downplayed the risks of Vioxx in advertising, according to a press release from Pennsylvania Attorney General Tom Corbett.
 
As part of the settlement, Merck will submit all television ads to the FDA for review before airing them for the next seven years and will follow all of the FDA’s proposed changes. Merck will also no longer engage in ghostwriting and will not use scientific data deceptively when marketing to physicians.
