Biovail agrees to $24.6M settlement for kickbacks

Pharma Compliance Alert, May 28, 2008

Illegal kickbacks used to induce physicians to prescribe Cardizem LA will cost Biovail Pharmaceuticals $24.6 million, according to a Department of Justice press release.

Beginning in 2003, Biovail used the Proving Long Acting Through Experience, or PLACE program, to accelerate the use of Cardizem LA.

Physicians and other medical professionals were paid $250 to enroll in the program and complete a two-page multiple choice questionnaire. If the prescriber returned the final questionnaire, he or she would be paid an additional:
  • $250 for enrolling between one and five patients
  • $500 for enrolling between six and 10 patients
  • $750 for enrolling between 11 and 15 patients
