Complaint over gift-ban bill could backfire on pharma company

Pharma Compliance Alert, May 14, 2008

A letter from a GlaxoSmithKline (GSK) executive to Massachusetts Governor Deval Patrick and legislative leaders could make lawmakers more determined to ban all gifts from pharmaceutical companies to physicians, according to an article in the Boston Herald.

Last week, Christopher A. Viehbacher, president of U.S. pharmaceuticals for GSK, sent letters to Patrick, Senate President Therese Murray, and House Speaker Sal DiMasi criticizing Murray’s proposed gift ban. The Massachusetts Senate approved the ban in April and the House is still considering it. If the measure passes, Massachusetts would become the first state to completely ban gifts to physicians.

In his letter, Viehbacher complained the state is against pharmaceutical companies and claimed some lawmakers were trying to attack the industry, according to the Herald. He did praise Patrick’s proposed $1 billion life sciences initiative.

Supporters of the gift-ban legislation said the letter could increase support for the bill, the Herald states.
